Petitioner seeks bail in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

Petitioner is husband of the victim who died in unnatural circumstance in her matrimonial house within 7 years of her marriage. There are two fold allegations against petitioner, one is that he was in illicit relation with a family member which led to the frequent quarrel between the two spouse and another is of demand of dowry.

Petitioner is in custody since 04.06.2017.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail for the present in connection with

Patna High Court Cr.Misc. No.11851 of 2018 (4) dt.08-05-2018 2/2 S.T. No. 871 of 2017 arising out of Nath Nagar Police Station Case No. 227 of 2017 pending in the court of learned 5th Additional Sessions Judge, Bhagalpur/successor court. Hence, prayer for bail is refused.

The learned trial court is directed to expedite and conclude the trial preferably within a period of nine months from the date of receipt/production of a copy of this order, failing which the petitioner would be at liberty to renew his prayer for bail before the court below itself who shall dispose of the prayer according to law.
