The petitioner is apprehending his arrest in connection with Chapra Nagar (Town) P.S.Case No.359/16 registered for offences punishable under Sections 399, 401, 413, 414 of the Indian Penal Code.

On the confidential information the police raided Bhikhari Chown and succeeded in apprehending four accused persons and 8-10 persons succeeded in fleeing away and from the apprehended persons, motorcycle, SIM card and the ATM Cards were recovered and they were a member of gang, who was engaged in withdrawal of money from the ATM by manipulation and snatching of motorcycle. They also disclosed the name of the petitioner rand other accused persons. Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused there is

Patna High Court CR. MISC. No.67048 of 2019(3) dt.23-10-2019 2/2 nothing against him and he has no criminal antecedent and one co-accused having similar allegation has been granted bail by a Co-ordinate Bench of this Court, vide order dated 17.10.2019 passed in Cr. Misc. No.44374 of 2017.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran, Chapra in connection with Chapra Nagar (Town) P.S.Case No.359 of 2016 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that after release within ten days, he has to appear before the I.O and co-operate in the investigation of this case . Let a copy of this order be sent to the Superintendent of Police of concerned district.
