JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 354B, 447, 504 and 506/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.

Petitioner is said to have entered into the house of informant and made attempt to outrage the modesty of the informant's daughter and, subsequently, the petitioner and others have assaulted the wife of the informant. Learned counsel appearing for the petitioner submits that according to the prosecution case itself, FIR named accused Madan Yadav had given rod blow causing head injury to the deceased and FIR named accused Pawan Yadav assaulted the deceased by means of Lathi. He, further, submits that so far

Patna High Court CR. MISC. No.66350 of 2019(2) dt.24-10-2019 2/2 as the petitioner is concerned, no specific overt act regarding assault has been levelled. He, further, submits that co-accused Pawan Yadav and Surendra Yadav have already been granted privilege of bail by a co-ordinate Bench of this Court and, moreover, there is land dispute between the parties and the Investigating Officer after investigation has not submitted chargesheet for the offence punishable under Section 354B of the Indian Penal Code.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that co-accused Pawan Yadav and Surendra Yadav, having more or similar allegation, have already been granted privilege of bail by a co-ordinate Bench of this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Presiding Officer, F.T.C., Sharasa/ concerned court in connection with Saur Bazar P.S. Case No. 530/2018 (S.T. No. 83/2019).
