2. The petitioner has prayed for bail in connection with Bhagwanpur P.S. Case No.132 of 2024 registered for the offence punishable under Sections 302 and 379 of the Indian Penal Code.

3. The case of the prosecution is that the informant after feeding his mother went back to his house on 21.05.2024. On next day when he came, he saw that her mother was lying dead in a pool of blood.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case due to village politics. It has further been submitted that

No.76838 of 2024(3) dt.23-01-2025 2/3 petitioner is the informant and during investigation, one Pramod Sah has given a statement that the deceased was having Rs. 5,00,000/- in her account. The petitioner used to demand that amount but she refuses and that he has killed his mother. Learned counsel for the petitoner has submitted that he has written down it in his petition that his mother was widow and the villagers caller her with a pseudo name 'dyne'. Initially the petitioner was the informant and on the basis of the statement of Pramod Sah, he has been named as accused. Learned counsel for the petitioner has also attached the photocopy of the account of mother of the petitioner which goes to show that there was only 2600 in one account and 500 in one account.

Through the story which has been propounded by Pramod Sah that the deceased was having Rs. 5,00,000/- in her account stands falsified. There is nothing except the statement of Pramod Sah. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Petitioner is languishing in judicial custody since 09.07.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is

The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No.132 of 2024.
