JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2019 This application, for grant of anticipatory bail, arises out of Panapur P.S. Case No. 182 of 2018, disclosing offences under Sections 363, 366A and 34 of the Indian Penal Code. Allegation is of kidnapping the minor daughter of the informant.
Submission of learned counsel for the petitioner is that he is not named in the F.I.R., his name has falsely been dragged in this case in supervision note only because, he happens to be younger brother of Raju Kumar, who is main accused in this case.
Heard learned A.P.P. also. He has opposed the prayer for anticipatory bail of the petitioner on the ground that para 63 and 64 of the case diary shows that some independent witnesses has named the petitioner but he has admitted that no

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Saran at Chapra, in connection with Panapur P.S. Case No. 182 of 2018, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure with further condition that petitioner will cooperate with the police in tracing out the girl.
