ANJANA MISHRA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Mairwa P.S. Case No.179 of 2019 registered for the offence under Section 30(a)/45 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that only on the basis of the statement made before the police by one coaccused person, the name of the petitioner has been drawn in connection with the present case. It is further submitted that the petitioner was named accused in Mairwa P.S. Case No.350 of 2017 and therefore, he has also been implicated in connection with the present case.

Considering the aforementioned facts and

No.68409 of 2019(2) dt.27-11-2019 2/2 circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Siwan, in connection with Mairwa P.S. Case No.179 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
