1. Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the Informant/opposite party no.2.

2. The petitioner apprehends his arrest in connection with Forbesganj P.S. Case no.369 of 2023 registered under section 498A of the Indian Penal Code and Section 3⁄4 of the D.P. Act.

3. The case is under Section 498A of the Indian Penal Code and petitioner is the husband. The allegation against him is of demand of dowry and torture.

4. Learned counsel for the petitioner submits that on exactly same set of allegation, anticipatory bail has already been granted to the petitioner in Cr. Misc. No. 77471 of 2024 whereby the petitioner has been directed to make payment of Rs.3,500/- to his wife and their child in the second week of

Patna High Court CR. MISC. No.80671 of 2024(5) dt.25-06-2025 2/2 every month for their basic requirements.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State as also learned counsel for the opposite party no.2.

6. In view of the above, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Forbesganj P.S. Case no.369 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
