The petitioner has been in custody since 10.02.2018 in connection with Muzaffarpur (Town) P.S. Case No. 87/2018 registered for the offences punishable under Sections 414/420/467/468/471/216(A)/292 of the Indian Penal Code and Section 65/66(D)/67/67(A) of the I.T. Act-2000. Learned counsel for the petitioner submits that the petitioner is a mobile shop owner who has been receiving sets from various customers for repair of the same. It is submitted that the police, with some oblique motive of implicating the petitioner, has levelled false and mischievous charges though nothing has come on record to indicate that the petitioner was indeed involved in the replacement of I.M.E.I. Numbers and creating new such
Patna High Court Cr.Misc. No.24102 of 2018 (3) dt.07-05-2018 2/2 I.M.E.I. Numbers. It is further submitted that all other similarly situated persons have since been extended the privilege of bail by a co-ordinate Bench of this Court in Cr. Misc. No. 17962 of 2018 vide order dated 02.04.2018.
Considering the fact that the petitioner's case stands on similar footing and the allegation is more or less the same, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur (Town) P.S. Case No. 87/2018.
