JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through the virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 21.10.2022.
The informant alleges that Aman Singh fired causing injury below his chest and thereafter fled away on the motorcycle of the petitioner.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case on account of dispute relating to election of Mukhiya. It is further submitted that petitioner is not alleged to have fired.
Patna High Court CR. MISC. No.723 of 2023(2) dt.04-03-2023 2/2 Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the submission aforesaid and the fact that petitioner is a person with clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bihiya P.S. Case No. 190 of 2022.
