The petitioner is languishing in custody for the offences punishable under Sections 364A/307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Though allegation is of demand of ransom and commission of assault for non-fulfillment of the same. However, the background of the allegation is that co-accused Gautam Kumar Choudhary had taken money from the informant for managing mutation of the name of the informant in the government record. The work was done. The FIR further reveals that during occurrence the petitioner sustained fire-arm injury. The petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 14.11.2017.
Patna High Court Cr.Misc. No.18998 of 2018 (4) dt.26-06-2018 Investigation of the case is already complete. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kotwali P.S. Case No.616 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
