Petitioner seeks bail in a case registered under Sections 376, 483, 328, 307 of Indian Penal Code. It is submitted by the learned counsel for the petitioner that the victim was in fact having a consensus relationship with the petitioner and that he has been falsely implicated in this case. It is further submitted that nothing has come in the course of investigation to suggest application of the provisions of Sections 328 and 307 of Indian Penal Code and that the petitioner is in custody since 26.10.2016. Learned APP on behalf of the State has opposed the prayer for bail. He has drawn attention of this Court towards the
Patna High Court Cr.Misc. No.16702 of 2018 (3) dt.27-04-2018 2/2 Discharge Slip issued by the Hospital where the victim was treated after the occurrence.
Having considered the heinous nature of allegation and on examining the Discharge Slip which shows that this case is one of suspected organochlorine poisoning, this Court, for the moment, is not inclined to grant bail to the petitioner. Prayer for bail is rejected.
