JUSTICE ARUN KUMAR ORAL ORDER 25-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 6.9.2015, seeks bail in Bhawanipur PS Case No. 197 of 2015 registered under Sections 304(B), 201 and 120B/34 of the IPC.

This is second attempt of seeking bail by the petitioner who is husband, an accused of killing his wife. Previously by order dated 17.11.2016 passed in Cr. Misc. No. 47952 of 2016 the prayer for bail of the petitioner was rejected with a direction to the trial court to expedite the trial and record sufficient progress within 10 months, failing which the petitioner may renew the prayer for bail in the court below itself.

However without preferring bail in the court below the petitioner has directly come to this Court, so his prayer for bail is rejected. The petitioner may renew the prayer for bail in the court below.
