JUSTICE MADHURESH PRASAD ORAL ORDER 23-05-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is an accused in a case registered for offence under sections 420, 427, 409/34 IPC and under section 135 of the Electricity Act.

Learned counsel for the petitioner submits that other than his own confessional statement there is no evidence whatsoever against the petitioner. It is also his case that the entire dues amounting to Rs.2.7 lacs which was due on the earlier meter has been deposited and as such it is not a case of any loss of revenue. Petitioner is in custody in connection with this case since 22.2.2018. Prior to lodging of this case, petitioner is a man of clean antecedent.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, PESU Area, Patna in Special case no. 72 of 2018, Patrakarnagar Police Station Case No. 91 of 2018 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.

(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
