JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Bahadurganj P. S. Case No. 226 of 2019 registered for the offences punishable under Sections 379 and 411, 34 of IPC. As per F.I.R. some miscreants have tried to commit theft of the motorcycle of the informant and on hulla, they were arrested including the petitioner.
Submission of the learned counsel for the petitioner is that on suspicion he has been made accused in this case. Nothing has been recovered from his possession. He is in custody since 29.07.2019. Charge sheet has already been submitted and as such, there is no chance of tampering with the evidence. One of the co-accused was arrested at the spot, has been granted bail by a Co-ordinate Bench of this Court, vide order dated 04.12.2019 passed in Criminal Misc. No. 74867 of
Patna High Court CR. MISC. No.70100 of 2019(2) dt.11-12-2019 2/2 2019. He has no criminal antecedent.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magisrate, Kishanganj, in connection with Bahadurganj P. S. Case No. 226 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
