JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-05-2018 The petitioner seeks bail in connection with Patna Kotwali P.S. Case No. 372 of 2017 instituted for the offences under Sections 417, 418, 419, 465, 468, 469, 471, 120(B) of the Indian Penal Code.
It has been alleged in the F.I.R that some of the miscreants have, for the purposes of misleading the students, brought out fake question paper on the social media. The petitioner is not named in the F.I.R. In fact, the F.I.R has been lodged against unknown. Without there being any basis, the petitioner is sought to be prosecuted in the present case. No concrete material has yet been garnered against the petitioner.
Patna High Court Cr.Misc. No.25023 of 2018 (3) dt.17-05-2018 2/2 The petitioner is in custody since 16.10.2017. Similarly situated co-accused person has been granted bail by a Bench of this Court in Cr. Misc. No. 10497 of 2018 vide order dated 23.02.2018.
The petitioner has been made accused in several cases of similar nature but it has been submitted that in most of those cases, the petitioner has been made accused only within a short span of two months and in most of the cases the petitioner has been granted bail.
Considering the facts, the petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Patna Kotwali P.S.
