2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 302 read with Section 34 of the Indian Penal Code.

3. The case of the prosecution is that the husband of the informant was murdered by unknown miscreants. The allegation against the petitioner is that he along with others cremated the dead body.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. It is also submitted that in FIR there is no allegation against him of committing the offence, but the allegation is that

In this case, petitioner has also given his confessional statement and in his statement, he has confessed his guilt. There is nothing except confessional statement against him. Similarly situated other co-accused person namely, Pramod Yadav has been granted bail by Coordinate Bench of this Court in Cr. Misc. No. 61215 of 2024. The case of this petitioner is of similar footing. It is further submitted that the petitioner is languishing in judicial custody since 08.04.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with N.T.P.C. P.S. Case No. 49 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Barh, Patna.
