This is a case registered under Sections 392, 395 and 412 of the Indian Penal Code.
It is submitted by the petitioner's counsel that the amount of Rs. 2500/- and mobile which is said to have been recovered from the petitioner during the investigation are bona fide property of the petitioner. He claims parity with co-accused Santosh Paswan and Amar Gupta @Amar Kumar who have been granted bail in Cr. Misc. No. 49459 of 2017 and Cr. Misc. No. 10561 of 2018 respectively. He submits that other than the statement of coaccused Baga @Kush Kumar and Rahul Kumar there is nothing to suggest the petitioner's involvement in the instant case. He is on bail in Charpokhari P.S. Case No. 84 of 2017 and prayer for bail
Patna High Court Cr.Misc. No.24248 of 2018 (3) dt.23-05-2018 2/2 in Piro P.S. Case No. 180 of 2017 is pending consideration before the Court. Petitioner is in jail custody since 16.08.2017 In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 10th Additional Chief Judicial Magistrate, Bhojpur (Arrah) in Charpokhari P.S. Case No. 173 of 2017 subject to the conditions :
(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.
(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
