2. This is the second attempt for bail of the petitioner. Earlier also, the prayer for bail of the petitioner was rejected by this Court vide order dated 19.03.2024 passed in Cr. Misc. No. 83845 of 2023.

3. Learned counsel for the petitioner vehemently argued the case and submits that it is a fit case for grant of bail to the petitioner.

4. Learned counsel for the informant submitted that out of eight witnesses four witnesses have been examined in the trial.

5. Considering the recent judgment of the Hon'ble Supreme Court in the case of X vs. State of Rajasthan 2024

Patna High Court CR. MISC. No.77027 of 2024(2) dt.11-12-2024 2/2 SCC Online SC 3539, I am not inclined to grant bail to the petitioner, when the trial is continuing and the witnesses are being examined, this application is dismissed.

6. Learned counsel for the informant undertakes that he will produce the witnesses on the next date of hearing.

7. The Superintendent of Police, Banka is directed to produce the I.O. and the doctor on the date fixed in the case so that the trial is not delayed.

8. Let a copy of this order be communicated to the Superintendent of Police, Banka through FAX for its forthwith compliance.
