This is an application for grant of anticipatory bail in connection with Ahiyapur P.S. Case No. 363 of 2019 registered for the offence punishable under Sections 341, 323, 379, 427, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding the accused persons including the petitioner herein having assaulted the informant causing injuries to him and thereafter, the petitioner and his accomplice are said to have snatched away a sum of Rs. 15000/- cash, gold chain etc. from the informant.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, he

Patna High Court CR. MISC. No.66367 of 2019(3) dt.03-12-2019 2/2 is having a clean antecedent and no recovery of the alleged stolen articles has been made from the house of the petitioner. It is further submitted that a bare perusal of the injury report, which is in paragraph no. 64 of the case diary, would show that the injuries are superfluous and simple in nature. The petitioner is stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Ahiyapur P.S. Case No. 363 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
