JUSTICE MADHURESH PRASAD ORAL ORDER 24-05-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are accused in a case registered for offence under sections 304B/201/34 IPC. Petitioners are father-in-law, brother-in-law and mother-in-law of the deceased respectively. Learned counsel for the petitioners submits that the husband of the deceased had been convicted under sections 304B and 201 IPC. Thereafter, this Court vide judgment dated 23.1.2018 has acquitted him of the charges observing that there is no evidence to support the dowry death. Learned counsel further submits that there is general and omnibus allegation against the petitioners. Petitioner no. 1 (father-in-law) and petitioner no. 2 (brother-in-law) are in custody since 26.3.2017 and petitioner no.3 (mother-in-law) is in custody since 13.7.2017. Let all the three petitioners above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II, Banka in Barahat Police Station Case No. 535 of 2016 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with them.

(b) They will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
