The petitioner seeks regular bail in connection with Balthar P.S. Case No. 101 of 2017 for the offences punishable under Section 302/34 of the Indian Penal Code. The allegation is regarding the victim lady having been killed by the accused person including the petitioner herein. The learned counsel for the petitioner has submitted that the perusal of the entire case diary would show that apart from suspicion, there is no material on record to connect the petitioner in the alleged crime, whereas one of the covillagers in para 29 of the case diary has stated that it might be the father of the victim lady who might have killed the victim lady on account of the fact that though the lady was Hindu,

Patna High Court Cr.Misc. No.23307 of 2018 (5) dt.02-07-2018 2/2 she had married with a Muslim boy. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 01.11.2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Seventh Additional Chief Judicial Magistrate, Bettiah, West Champaran in connection with Balthar P.S. Case No. 101 of 2017.
