JUSTICE SUDHIR SINGH ORAL ORDER 11-05-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 498A, 326, 307, 506 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act and subsequently added Section 304B of the I.P.C.
Allegation is that the accused persons including the petitioner committed murder of the sister of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.1.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been

The witnesses in paragraphs 9, 10, 11 and 12 of the case diary have stated that the victim had committed suicide. The charge sheet has been submitted for an offence under Section 306 of the I.P.C. and the cognizance has also been taken under Section 306 of the I.P.C. Hence, no offence under Section 304B of the I.P.C. is made out. On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S. case No.634 of 2017.
