The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Prosecution story in short is that the informant in his written information that on 13.06.2019 at about 15.00 hours when he was going by motorcycle with his associate to deposit Rs.13,38,000/- of his company in bank but in the way unknown accused persons surrounded his motorcycle and under threat of fire arms, looted away the said money and thereafter fled away from the place of occurrence.
Learned counsel for the petitioner submits that the petitioner is quite innocent and has committed no offence. He further submits that petitioner's name has figured on the basis of
Patna High Court CR. MISC. No.70654 of 2019(2) dt.25-11-2019 2/2 confessional statement of co-accused Sudhir Kumar. He further submits that chargesheet has already been submitted and there is no allegation of tampering of witnesses as alleged against the petitioner. He further submits that the petitioner is not named in the FIR. Learned counsel for the petitioner further submits that similarly situated co-accused has already been granted bail by a coordinate Bench of this Court in Cr.Misc.No.63776 of 2019 vide order dated 14.11.2019.
In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Darbhanga, in connection with Bahadurpur P.S.Case No.279 of 2019.
