JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Town (Chapra) P.S. Case No. 224 of 2017 instituted for the offences punishable under Section 393 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation is regarding unknown persons having tried to snatch the bag from one Upendra Kumar Yadav, the informant of the present case, when he was going to deposit a cash of Rs. 22 lakhs of the Railways in the S.B.I. Main Branch, Chapra.
The learned counsel for the petitioner submits that neither any recovery has been made from the petitioner nor any T.I. Parade has been held so as to ascertain the identity of the
Patna High Court Cr.Misc. No.24322 of 2018 (3) dt.03-07-2018 2/2 petitioner as an accused in the present case. It is further submitted that only because the petitioner is an accused in other cases, he has been roped in the present case and remanded in the present matter. The petitioner is languishing in custody since 29.06.2017. It is submitted that the petitioner is on bail in all other cases in which he has been implicated. Lastly, it is submitted that the similarly co-accused persons have been granted bail by orders dated 29.12.2017 and 11.01.2018 passed in Criminal Misc. No. 61469 of 2017 and Criminal Misc. No. 62337 of 2018.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Saran at Chapra in connection with Town (Chapra) P.S. Case No. 224 of 2017.
