JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This is an application for grant of anticipatory bail in connection with Madhepura (Bharrahi) Case No. 513 of 2019, disclosing offences under Sections 341, 323, 325, 307, 379, 354A, 504, 34 of the Indian Penal Code and Section 27 of the Arms Act.
As per F.I.R. petitioners and other accused persons came variously armed and one Nanhaku @ Nand Kishore Ram assaulted husband of the complainant by rod and other accused persons have assaulted her husband by lathi on his leg and hand, causing fracture injury.
Submission of the learned counsel for the petitioners is that there is case and counter case between the parties. Though the injuries are grievous in nature, but that is on the

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M. Madhepura, in connection with Madhepura (Bharrahi) Case No. 513 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
