The petitioner is in custody since 04.09.2019 in connection with Turkauliya (Raghunathpur) P.S. Case No. 147/2019 registered for the offence punishable under Sections 30(a), 38(1) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from a pickup van and his name was taken on the confessional statement of co-accused Upendra Rai. It is further submitted that the petitioner has no criminal antecedents. In view of the aforementioned facts and circumstances, let the petitioner above named be released on
