2. The petitioner seeks bail in a case registered for offence under Sections 302, 120B of the Indian Penal Code.

3. The prosecution case, in brief, is that on 29.09.2023, the son of the informant went outside of his house on calling of the petitioner and others to do panchayati of Mobile, but he did not return till late night. During search, the informant's son was found dead beside the Railway line. Informant suspects that this petitioner and other co-accused persons committed murder of his son.

4. Learned counsel for the petitioner submits that informant is not eye-witness to the occurrence and has raised only suspicion against petitioner and others. Except suspicion,

Patna High Court CR. MISC. No.74750 of 2025(2) dt.04-11-2025 2/2 there is no other tangible material against this petitioner to show his complicity in the alleged occurrence. Petitioner has got clean antecedent and is in custody since 27.06.2025.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 502 of 2023.
