The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 323, 307, 504, 354 of the Indian Penal Code.

The prosecution case in nutshell is that petitioner started abusing and assaulting the wife of informant and when the informant came to his rescue he was also assaulted by the petitioner by means of Axe due to which he sustained head injuries.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.73960 of 2022(2) dt.21-03-2023 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. There is no repetition of blow. There is land dispute between the parties. From perusal of the injury report (Annexure 2) it appears that informant sustained lacerated wound on skull in left perital region and abrasion on left shoulder and left buttock. Injury number is hair line fracture as opined by the doctor. The injury report is not in consonance with the prosecution version of the case. Moreover, the petitioner is languishing in judicial custody since 06.09.2022.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Garhi P.S. Case No. 30 of 2022
