The petitioner seeks bail in connection with Sheohar P.S. Case No. 157 of 2024 instituted for the offence under Sections 302, 201 & 34 of the Indian Penal Code. 3.

Prosecution case in short is that Amrita Devi married to Ram Sringar Paswan in 2017, was later enticed by Mukesh Paswan into a relationship and kidnapped along with her minor daughter. After being recovered in a prior case, Amrita married Mukesh and became six months pregnant, but on 12-05-2024, the informant learned that both Amrita and her daughter had been murdered and their bodies had been hidden. 4.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.76964 of 2024(6) dt.20-02-2025 2/3 that the petitioner is in custody since 05-09-2024. Petitioner bears no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is the brother of the Mukesh Paswan. No specific allegation is attributed to the petitioner, rather same is general and omnibus in nature. Petitioner is living separately from his brother since last five years. Petitioner has no role in the commission of the alleged occurrence, even in the case diary. Charge sheet has been submitted in this case. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is submitted by referring to paragraph No. 82 of the case diary that witnesses have levelled specific allegation against co-accused, Mukesh Paswan and dead bodies have been recovered from his house.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation against the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on

Patna High Court CR. MISC. No.76964 of 2024(6) dt.20-02-2025 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sheohar P.S. Case No. 157 of 2024.
