Mr. Awadhesh Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 21-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sabour P.S.Case No. 154 of 2016 registered under Sections 323,341,366A and 504/34 of the Indian penal Code.

Allegation in brief is that petitioner kidnapped the minor daughter of the informant and also raped her during captivity. Submission is that petitioner has been falsely implicated and is in custody since 13.03.2017 and some of the witnesses have been examined.

Whereas learned counsel for the State submits that as per medical report, girl is minor, she has supported the allegation in her statement recorded under Section 164 Cr.P.C. and medical report also confirms the rape committed to her. The report, received from the trial court, shows that trial

Patna High Court Cr.Misc. No.10540 of 2018(6) dt.21-06-2018 2/2 is at the fag end, so considering that only three witnesses remain to be examined, the prayer of bail of the petitioner is rejected.

The trial court is directed to conclude the trial preferably within six months. If trial does not get concluded within the stipulated period, petitioner may renew his prayer of bail. (Arun Kumar, J) sujit/- U T
