JUSTICE ARUN KUMAR ORAL ORDER 16-07-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Gogri P.S.Case No. 453 of 2017 registered under Sections 302/34 of the Indian penal Code. Allegation in brief is that informant's son had gone to his father's-in-law place by his tempo and information was received later on that his dead body was found near the father's -in-law house as someone had shot at him and both petitioners were found missing from there so their hands are suspected in killing the deceased.

Submission is that deceased is the own son-in-law of the petitioner no. 1 and petitioner no. 2 is his son, and there is no motive or evidence against the petitioners of killing the deceased and dead body was found in open place and there was

Patna High Court Cr.Misc. No.15771 of 2018(5) dt.16-07-2018 2/2 no any strain relationship between the deceased and his wife. Learned counsel for the informant opposed the prayer of bail.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Bechan Sharma and Dhiraj Sharma @ Dhiraj Kumar are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria in connection with Gogri P.S. Case No. 453 of 2017.
