Petitioners are apprehending their arrest in connection with Govindpur P.S.Case No.219 of 2018 , registered for offences punishable under Sections 409/34 of the Indian Penal Code.
As per the FIR, there is allegation against the petitioner , who happens to be a Panchayat Secretary, that he has not handed over the folder relating to the appointment of Panchayat Teacher in spite of direction given to him. Submission of the learned counsel for the petitioners is that is that he joined as Panchayat Secretary on 16.7.2016 and
Patna High Court CR. MISC. No.69208 of 2019(2) dt.14-11-2019 2/2 no folder was submitted to him by his predecessor and he is ready to abide by any condition imposed upon him. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below within a period of three weeks and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Govindpur P.S.Case No.219 of 2018 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure on condition that he has to cooperate in the investigation as well as any inquiry if pending.
