Petitioner apprehends his arrest in a case registered for the offence punishable under Section 430, 467, 468, 471, 120(b) of the Indian Penal Code.

As per the prosecution case, this petitioner got appointment on the post of Niyojit Teacher on the basis of forged and fabricated educational certificates. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that without proper verification and notice the certificate of the petitioner has been declared forged and fabricated. It is next submitted that vide memo No. 3638 dated 23/07/2022 issued by the DPO (estb), Bhojpur the

Patna High Court CR. MISC. No.979 of 2023(3) dt.16-05-2023 2/2 petitioner has been dismissed from service with further direction for recovery of salary from the petitioner. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Bhojpur, Ara in connection with Shahpur PS case No. 217/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
