JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-10-2019 This application, for grant of anticipatory bail, arises out of Angarghat P.S. Case No. 61 of 2019, disclosing offences under Sections 307, 323, 324/34, 341, 506 of the Indian Penal Code and Section 27 of the Arms Act Allegation against the petitioner is of firing causing injury to the informant and later on petitioner and other accused persons also threatened the informant.

Submission of learned counsel for the petitioner is that so far this case is concerned, injury sustained by the informant was found simple in nature.

Heard learned A.P.P. as well as learned counsel for informant, who has appeared suo motu has opposed the prayer for anticipatory bail and submitted that the petitioner is also threatening the informant and for that a separate case has also

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the basis of materials available on record, if possible on same day, without being prejudiced by this order.

This application is, accordingly, dismissed.
