JUSTICE ARUN KUMAR ORAL ORDER 06-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Raj Nagar P.S.Case No. 222 of 2017 registered under Section 394 of the Indian penal Code.

Submission is that robbed motorcycle of the present case was recovered from the possession of one Rajesh Sah and not from the possession of this petitioner, he was not put on TIP also and has been made accused on the basis of disclosure of his name by Rajesh Sah in his confessional statement and this petitioner has no criminal antecedent of robbery and dacoity. He submits that petitioner has only one case under SC/ST Act which was disposed of on the basis of compromise and has been in custody in this case since 26.12.2017.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.14548 of 2018(6) dt.06-07-2018 2/2 the petitioner, namely, Harish Kunwar @ Haresh Kauwar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. Vikash Jha, J.M. 1st Class, Madhubani in connection with Raj Nagar P.S. Case No. 222 of 2017. (Arun Kumar, J) sujit/- U T
