The petitioner is in custody since 28.08.2019 in connection with Imamganj P.S. Case No. 149 of 2019 for the offence registered under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the name of the petitioner has been brought in connection with the present prosecution only because of suspicion alleging that certain persons namely, Lal Babadur Rai, Dinesh Rai, Kamlesh Rai, Satish Rai (petitioner) and Ramraj Rai had threatened her son Vikash Kumar (deceased) that they will be killed. It was suspected by these persons that the wife of one co-accused, Lal Bahadur Rai had been kidnapped by the informant's son which

Learned counsel for the petitioner further submits that one Kamlesh Rai being a similarly situated co-accused has since been extended the privilege of bail vide order dated 21.11.2019 passed in Cr. Misc. No. 72798 of 2019. It is further submitted that the petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case and that the allegation being based merely on suspicion, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Sherghati (Gaya) in connection with Imamganj P.S. Case No. 149 of 2019.
