Petitioner is husband of the deceased.
Earlier prayer for bail of the petitioner was rejected by this court vide order dated 27-03-2017 passed in Cr. Misc. No. 6159 of 2017. The petitioner was given liberty to renew his prayer for bail after nine months, if, no substantive progress is made in the trial.
The report, called for from the trial court has been received.
From the report, it appears that the case was not committed to the court of Sessions because one accused namely, Vidya Sagar Singh was not being produced from custody. Now, the case has been committed to the court of Sessions on 17-01-
Patna High Court Cr.Misc. No.3040 of 2018 (7) dt.16-05-2018 2018. The learned Sessions Judge has mentioned in the report that the case is pending for evidence.
In such circumstances, keeping in view the direct allegation against the petitioner, this court is not inclined to grant him bail at this stage.
Accordingly, prayer for bail is rejected.
The court below is directed to expedite the trial of the petitioner by giving short adjournments in accordance with law and try to conclude the same within a period of six months from the date of receipt/production of copy of this order. (Sanjay Priya, J) A.K.V./- U T
