JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Ladaniya P.S. Case No. 126 of 2019, registered for the offences punishable under Sections 304 (B), 201/34 of the Indian Penal Code.
As per FIR the case is of dowry death and the petitioners is named in the F.I.R with an allegation that both along with others disposed of the dead body.
Submission of learned counsel for the petitioners is that they are co-villagers, there is no other allegation except that they have assisted in disposing of the dead body. On the other hand, learned A.P.P. has opposed the prayer of bail of the petitioners.
Patna High Court CR. MISC. No.72708 of 2019(2) dt.19-11-2019 2/2 Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate IVth, Madhubani in connection with Ladaniya P.S. Case No.-126 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
