JUSTICE ARUN KUMAR ORAL ORDER 02-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 7.12.2015, seeks bail in Ara Nawada PS Case No. 168 of 2015 registered under Sections 399, 402, 120B of the IPC and Sections 25(1-B)a, 26, 35 of the Arms Act. Learned Counsel for the petitioner seeks bail of the petitioner on the ground of parity as one of the co-accused Dani Yadav who was in custody at the time of alleged occurrence was granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 40697 of 2016.

Having considered the said facts and circumstances, the petitioner, namely, Bablu Tatwa @ Bablu Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhojpur at Ara in connection with Ara Nawada PS Case No. 168 of 2015 with the following conditions:- (i) that one of the bailors shall be a close family member of the petitioner; and (ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
