2. The petitioner has renewed his prayer for grant of regular bail in connection with S.Tr. No. 82 of 2025 arising out of Ahiyapur P.S. Case No. 229 of 2024 registered for the offence punishable under Sections 302/34 of the Indian Penal Code which was earlier rejected by this Court vide order dated 03.03.2025 passed in Cr. Misc. No. 78516 of 2024 with a liberty to renew his prayer for bail after six months if the trial is not concluded.
3. The case of the prosecution in short is that on 18.02.2024 at about 06:00 PM, the son of the informant had gone to take vegetables; when he did not return till night, the informant called on his mobile at 06:30 PM. He said he would

The informant came to know on 19.02.2024 that some dead body had been sent to SKMCH; when the informant went to SKMCH, he identified the body of his son.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Learned counsel for the petitioner submits that a report has also been called from the learned trial court, and from perusal of which it is clear that only two witnesses have been examined till today. He also submits that during the course of the investigation on the basis of the CDR, this petitioner was apprehended. The petitioner has also given his confessional statement, and in his confessional statement, he has admitted his guilt. He also submits that save and except the CDR and the confessional statement of the petitioner, there is nothing against him. It has also been submitted that the trial has not been concluded. Moreover, Petitioner is languishing in judicial custody since 08.08.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and
Patna High Court CR. MISC. No.72726 of 2025(3) dt.21-11-2025 3/3 considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 11th District & Additional Sessions Judge, Muzaffarpur in connection with S.Tr. No. 82 of 2025 arising out of Ahiyapur P.S. Case No. 229 of 2024.
7. Accordingly, the bail petition of the petitioner stands allowed.
