====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 03-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends arrest in a case registered under Sections 126(2), 115(2), 117(2), 109(1), 303(2), 352, 351(1) and 3(5) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, it is alleged that all the F.I.R. named accused persons including the petitioner assaulted the informant and his father with iron rod, farsa due to which they sustained injuries.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Further submission is that the informant, namely Suvin Kumar is the cousin brother of the petitioner and due to land dispute, some altercation took place between the parties, causing

Patna High Court CR. MISC. No.72929 of 2025(2) dt.03-11-2025 2/2 case and counter case between the parties. The injuries to the informant are simple in nature. Petitioner has no criminal antecedent and he undertakes to cooperate in the investigation and trial. There is no chance of absconding of the petitioner or tampering with the evidence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the learned Court of Additional Sessions Judge-VII, Jamui in connection with Sono P.S. Case No. 148 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023. (Sunil Dutta Mishra, J) utkarsh/- U T
