The petitioner seeks bail in a case registered under Section 436/34 of the Indian Penal Code.
The prosecution case in short is that one night, the cloth shop of the informant was set ablaze by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 27-07-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. Civil dispute is going on between the parties and for the said reason, the present case has been instituted. The matter has already been compromised between
Patna High Court CR. MISC. No.66534 of 2019(3) dt.27-11-2019 2/2 the parties vide Annexure-2 to the present application. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya [Raghunathpur] P.S.
