Mr. Sanjeev Kumar, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 11-07-2018 Heard learned counsel for the petitioner, the learned APP for the State as well as the learned counsel appearing on behalf of the informant.
Petitioner, already in custody, seeks bail in connection with Agamkuan P.S. Case No.431 of 2017 registered under Sections 328, 304(B), 34 of the Indian Penal Code. Allegation in brief is that approximately after a year of the marriage, the wife of the petitioner was done to death for non-fulfillment of demand of dowry and she was killed by poisoning.
Learned counsel for the petitioner submits that the allegation is not true and it was not a case of poisoning. However, the FSL report indicates that in the viscera
Patna High Court Cr.Misc. No.7628 of 2018(7) dt.11-07-2018 2/2 of the deceased highly poisonous substance was found and within span of one year of the marriage she died in unnatural way.
Having considered the aforesaid facts and circumstances, the Court is not persuaded to grant bail to the petitioner at this stage. Accordingly, the prayer of bail of the petitioner is rejected.
