Petitioner seeks bail in a case registered for the offences punishable under Sections 396/412 of the Indian Penal Code.
The FIR of the occurrence of dacoity with murder is against unknown. During investigation on disclosure of some other co-accused, some looted articles i.e. computer parts were recovered from the house of the petitioner. Petitioner is in custody since 21.09.2012. In the past, prayer for bail of the petitioner was refused thrice vide Annexure-1 series.
Submission is that only four witnesses have been examined up-till-now during trial in connection with S.Trial No.1015 of 2012.
Considering the nature of material and period already undergone by the petitioner, let the petitioner, above
Patna High Court Cr.Misc. No.6708 of 2018 (4) dt.23-04-2018 named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No.1015 of 2012 arising out of Patliputra Police Station Case No.216 of 2006, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
