ANJANA MISHRA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Hathouri P.S. Case No.104 of 2019, G.R. No.966/2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the only because the petitioner's motorcycle was recovered, from where the alleged recoveries were made, the petitioner has been implicated in connection with present case. It is further submitted that the petitioner has no concern with the same, from were the recoveries were made.

Considering the aforementioned facts and circumstances and that there is one other case of family dispute

Patna High Court CR. MISC. No.68421 of 2019(2) dt.27-11-2019 2/2 between the extended family members, there is no other criminal case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District & Sessions Judge Cum Special Judge, Excise, Samastipur, in connection with Hathouri P.S. Case No.104 of 2019, G.R. No.966/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
