====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-03-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offence punishable under Sections 30(a) and 36 of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 15 liters illicit county made liquor has been recovered from stolen Activa scooty. Learned counsel appearing for the petitioner submits that the petitioner is innocent and have falsely been implicated in this case. It is submitted that petitioner is owner of the vehicle in question which was stolen on 09.04.2022, for which F.I.R. has been lodged by the petitioner on 10.04.2022 bearing Khajekalan P. S. Case No. 103 of 2022 and as such, he cannot be held responsible for the same. Nothing has been recovered

Patna High Court CR. MISC. No.74208 of 2022(2) dt.18-03-2023 2/2 from conscious possession of the petitioner. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge Excise, Patna City in Agamkuan P. S. Case No. 298 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
