The petitioner seeks regular bail in connection with Bairgania P.S. Case No. 108 of 2015 for the offences punishable under Sections 395 of the Indian Penal Code.
The allegation against the accused persons is entering the house of the informant and committing loot of ornaments, mobile and other household articles.
The learned counsel for the petitioner submits that the petitioner is a non-FIR named accused persons, no recovery has been made from his house and the petitioner has not been put on T.I. Parade till date and he has merely been implicated on the basis of the confessional statement made by one Nagina Singh, who has already been granted bail by this Court in Criminal Misc.
Patna High Court Cr.Misc. No.23251 of 2018 (4) dt.29-06-2018 2/2 No. 36482 of 2017. It is further submitted that the petitioner is languishing in custody since 11.12.2017.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bairgania P.S. Case No. 108 of 2015.
