Petitioner is an accused in a case registered for offence under sections 25 (1-B)a/26/35 of the Arms Act and sections 27(b)(ii), 23/36 of the Drugs and Cosmetic Act. Learned counsel for the petitioner submits that the petitioner is accused in one more case. He is a teacher working in the Government school and the recovery has been made from the shop which he has let out to one Md. Wasim and he has no concern with the recovery made from his house. He submits that the petitioner has falsely been implicated in this case only on basis of confessional statement made by said Md.Wasim. Petitioner is in custody since 16.12.2017.

Considering the aforesaid submissions, prayer for bail

Patna High Court Cr.Misc. No.17959 of 2018 (3) dt.09-05-2018 of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Forbesganj (Simraha) Police Station Case No. 942 of 2017 on the following conditions:- One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
