The petitioner seeks bail in Begusarai Muffasil P.S. Case No.274 of 2014 registered under Section 147, 148, 149, 341, 324, 384, 385, 307, 447 and 364 of the Indian Penal Code. Petitioner is said to have resorted firing upon the informant who left unhurt then the petitioner assaulted on jaw of the brother of the informant by means of bamboo causing grievous injury on his face over land dispute.
It is submitted by learned counsel for the petitioner that there is a case and counter case between the parties. A proceeding under Section 145 Cr.P.C. is pending between the
Patna High Court Cr.Misc. No.18401 of 2018 (04) dt.17-05-2018 - 2 - parties. There is no repetition of blow. Though the petitioner was granted anticipatory bail by the learned Sessions Judge but under mistake of fact about concealment of material information by the petitioner it was recalled but no concealment has been made by the petitioner rather by other accused persons, namely, Sunil Sah and Sal Sah. The petitioner has been languishing in custody since 28.01.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No.274 of 2014.
