JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioners seek bail in anticipation of their arrest in connection with A. P. M. (Ashok Paper Mill) P.S. Case No. 85 of 2019 registered for the offences punishable under Sections 341, 323, 376, 504, 506 and 34 of the Indian Penal Code. As per FIR one Dilip Yadav committed rape upon the informant and when she raised alarm it is alleged that petitioners came and assaulted her.
Submission of learned counsel for the petitioners is that there is no allegation of rape against the petitioners and though there is allegation of assault against the petitioners but except 376 IPC all sections are bailable.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with A.P.M. (Ashok Paper Mill) P.S. Case No. 85 of 2019, corresponding to C.R.I. 1646 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
